1. Agreement to these Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("you," "User," or "Customer") and the operator of Piveth identified in Section 2 ("Piveth," "we," "us," or "our").
By accessing or using the Piveth website (piveth.com), applications, dashboards, APIs, voice features, chat features, or any related services (collectively, the "Service"), you agree to these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, do not use the Service.
If you use the Service on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.
2. Who operates Piveth
The Service is operated by Roktim Saha, trading as Piveth ("Operator"). References to "Piveth" in these Terms mean the Operator unless context requires otherwise.

3. The Service
Piveth is an AI-assisted finance organization platform designed for founders, entrepreneurs, builders, and small business operators who manage capital, expenses, revenue, cash flow, and project-wise finances across one or more projects or ventures.
The Service may include, without limitation:
- Project and workspace finance tracking (capital, expenses, revenue, burn, runway, cash flow, P&L views);
- Natural-language and voice-based logging of financial entries;
- AI chat, insights, summaries, scenarios, alerts, and recommendations;
- Dashboards, calendars, reports, exports, and activity feeds;
- Team workspaces, invitations, and role-based access;
- Integration with third-party AI and speech providers using credentials you supply; and
- Features we add, modify, or remove over time.
We may offer free, trial, beta, or paid tiers. Features may change, be limited, or be discontinued at any time. We do not guarantee uninterrupted availability, specific uptime, or that any feature will remain available permanently.
The Service is not a substitute for professional accounting systems, ERP software, tax filing, statutory audit, payroll, invoicing with legal validity, payment processing, banking, or regulatory reporting unless we explicitly state otherwise in writing.
4. No professional advice
You acknowledge that:
- Financial figures in the Service depend entirely on data you or your team enter, import, or instruct the AI to record;
- Runway, burn, health scores, and affordability answers are estimates based on that data and assumptions, not guarantees;
- You must verify all entries, reports, and AI outputs before relying on them for business, tax, investment, hiring, lending, or legal decisions;
- You should consult qualified accountants, tax professionals, lawyers, and financial advisers for your jurisdiction; and
- No fiduciary, advisory, or trustee relationship is created between you and Piveth.
5. AI, voice & automation
5.1 AI limitations
The Service uses artificial intelligence and automated parsing. AI systems can misunderstand speech, misclassify transactions, invent amounts, assign wrong projects, or produce incomplete or incorrect responses. You are solely responsible for reviewing, confirming, correcting, or undoing any entry before and after it is saved.
5.2 Voice & microphone
Voice features may use your device microphone and third-party speech-to-text or text-to-speech services. By enabling voice, you consent to audio processing as described in our Privacy Policy. You must not record others without lawful consent.
5.3 Automated actions
When you instruct Piveth to log, edit, delete, reset, or navigate financial data, you authorize the Service to perform those actions on your behalf within your workspace. You remain responsible for all resulting ledger entries.
5.4 No guarantee of AI availability
AI features require valid third-party credentials (such as an OpenAI API key) where applicable. We do not guarantee AI availability, model quality, latency, or compatibility with any provider.
6. Your API keys & third-party services
Parts of the Service operate on a bring-your-own-key ("BYOK") basis. You may provide API keys or credentials for providers such as OpenAI, Deepgram, or others we support.
You agree that:
- You are solely responsible for obtaining keys, complying with each provider's terms, paying their fees, and maintaining key security;
- Piveth may transmit your prompts, transcripts, and contextual data to those providers to deliver the Service;
- We store credentials using encryption at rest where implemented, but no system is perfectly secure;
- We are not liable for acts, outages, pricing changes, data handling, or policy changes of third-party providers;
- Google Sign-In and other OAuth providers are governed by their own terms and privacy policies; and
- Bank connections, payment gateways, and accounting integrations—if offered in future—will be subject to additional terms.
7. Accounts & security
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service.
You agree to provide accurate registration information, keep your password confidential, and notify us promptly at [email protected] of unauthorized access. You are responsible for all activity under your account unless caused by our gross negligence or wilful misconduct.
We may require email verification, onboarding steps, or additional authentication. We may refuse, suspend, or terminate accounts that violate these Terms or pose security or legal risk.
8. Workspaces & team access
The Service supports shared workspaces. Workspace owners and administrators control invites and permissions. You are responsible for:
- Who you invite and what access they receive;
- Financial data visible to workspace members;
- Actions taken by members you authorized; and
- Removing access when team members leave your organization.
Piveth is not responsible for disputes between workspace members regarding data access, edits, or financial decisions.
9. Your data & accuracy
"User Content" means all data you submit: ledger entries, project names, capital amounts, chat messages, voice transcripts, files, reports, and settings.
You retain ownership of your User Content. You grant Piveth a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and backup User Content solely to operate, secure, improve, and support the Service, and as described in our Privacy Policy.
You represent and warrant that:
- You have all rights necessary to submit User Content;
- Your User Content does not violate law or third-party rights;
- You will not submit others' personal data without lawful basis and notice where required; and
- You are solely responsible for the accuracy, completeness, and legality of financial records you maintain in Piveth.
You are responsible for maintaining your own backups and official books of account. We may delete or anonymize data after account closure subject to our retention policies and applicable law.
10. Acceptable use
You may not, and may not permit others to:
- Use the Service for unlawful, fraudulent, or deceptive purposes;
- Upload malware, scrape or reverse engineer the Service except where law permits;
- Attempt unauthorized access, overload infrastructure, or bypass rate limits;
- Use the Service to launder money, evade sanctions, or violate export control laws;
- Harass, impersonate, or infringe intellectual property or privacy rights;
- Use the Service to provide regulated financial services to third parties without proper licensing;
- Resell, sublicense, or white-label the Service without written permission; or
- Use automated means to abuse AI features or generate excessive provider costs on our infrastructure.
We may investigate violations and cooperate with law enforcement where required.
11. Fees & beta features
Some features may currently be free or offered as beta. We may introduce paid plans, usage limits, or metering in the future. If fees apply, we will present pricing before charging you.
Beta or early-access features are provided "as is" with higher risk of bugs, data loss, or change. You accept that beta features may be modified or withdrawn without notice.
Except where required by applicable consumer law, fees are non-refundable once a billing period has started.
12. Intellectual property
The Service, including software, design, branding, logos, documentation, and underlying technology, is owned by Piveth or its licensors and protected by intellectual property laws. These Terms grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your internal business purposes while you comply with these Terms.
You may not copy, modify, distribute, sell, or create derivative works of the Service except as law expressly allows. Feedback you provide may be used by us without restriction or compensation to you.
If you believe content on the Service infringes your copyright, email [email protected] with: identification of the work, the infringing material, your contact details, a good-faith statement, and your signature (physical or electronic).
13. Privacy
Our Privacy Policy explains how we collect and process personal data. By using the Service, you acknowledge that data may be processed in India and other countries where we or our providers operate.
If you are in the European Economic Area, United Kingdom, or other regions with data protection laws, you may have statutory rights regarding access, correction, deletion, portability, and objection. Contact [email protected] to exercise applicable rights. Nothing in these Terms limits rights that cannot be waived under mandatory law.
14. Disclaimers
We disclaim all warranties including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements, that AI outputs will be correct, or that defects will be corrected.
Additional product-specific limitations (AI errors, runway estimates, no professional advice, third-party BYOK providers, and marketing content) are set out in our standalone Disclaimer, which is incorporated by reference into these Terms.
Some jurisdictions do not allow exclusion of certain warranties; in those cases, exclusions apply to the fullest extent permitted.
15. Limitation of liability
Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amounts you paid to Piveth for the Service in the twelve (12) months before the event giving rise to liability, or (b) one hundred U.S. dollars (USD $100) or equivalent in local currency.
These limits apply to all theories of liability (contract, tort, negligence, strict liability, or otherwise) and survive termination.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including fraud or wilful misconduct where not excludable).
16. Indemnification
You will defend, indemnify, and hold harmless Piveth and its founder, officers, employees, contractors, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the Service;
- Your User Content or financial records;
- Your violation of these Terms or applicable law;
- Your violation of third-party rights, including provider terms for API keys you supply;
- Disputes with workspace members or third parties; or
- Tax, regulatory, or compliance failures based on data you maintained in Piveth.
We may assume exclusive defense of any matter subject to indemnification; you will cooperate at your expense.
17. Suspension & termination
You may stop using the Service at any time. You may request account deletion by contacting [email protected].
We may suspend or terminate access immediately if you breach these Terms, create risk for us or other users, fail to pay fees when due, or if required by law. Upon termination, your license ends and we may delete or retain data as permitted by law and our policies.
Sections that by nature should survive (including disclaimers, limitation of liability, indemnification, dispute resolution, and governing law) survive termination.
18. International users
The Service is controlled from India. If you access the Service from outside India, you do so on your own initiative and are responsible for compliance with local laws, including data protection, tax, and export regulations.
You may not use the Service if you are located in, ordinarily resident in, or subject to comprehensive sanctions in a country or territory embargoed by India, the United States, or other applicable sanctions authorities, or if you are a prohibited or restricted party on applicable government lists.
19. Disputes & governing law
19.1 Informal resolution
Before filing a formal claim, you agree to contact [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.
19.2 Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
19.3 Jurisdiction
Subject to Section 19.4, you agree that courts located in Kolkata, West Bengal, India shall have exclusive jurisdiction over disputes that are not subject to arbitration, and you consent to personal jurisdiction there.
19.4 Arbitration (optional escalation)
At Piveth's sole discretion, any dispute may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), seated in Kolkata, in English, before a single arbitrator. Either party may seek interim injunctive relief in court to protect intellectual property or confidential information.
19.5 Class action waiver
To the fullest extent permitted by law, disputes must be brought individually and not as a plaintiff or class member in any purported class, collective, or representative proceeding. If this waiver is unenforceable in your jurisdiction, it applies only to the extent allowed.
20. Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms on piveth.com with an updated "Last updated" date. Material changes may also be notified by email or in-app notice where practicable.
Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Service before the effective date of the new Terms.
21. General
- Entire agreement. These Terms and referenced policies are the entire agreement regarding the Service.
- Severability. If any provision is unenforceable, the remainder stays in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond reasonable control (including outages, acts of God, war, labor disputes, or provider failures).
- Language. These Terms are written in English. Translations are for convenience only; the English version controls.
- Third-party beneficiaries. None except Piveth and you.
